By accessing or using Painscout ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Painscout is a SaaS platform that helps entrepreneurs and developers discover validated business opportunities by analyzing pain points expressed in online communities. The Service aggregates and analyzes publicly available data to identify potential product opportunities.
3. User Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:
- Safeguarding the password that you use to access the Service
- Any activities or actions under your account
- Notifying us immediately upon becoming aware of any breach of security
You may not use as a username the name of another person or entity that is not lawfully available for use, or a name or trademark that is subject to any rights of another person or entity without appropriate authorization.
4. Subscription and Payment
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly or annual basis.
- Free Trial: We may offer a free trial with limited features. You are not required to provide payment information for free trials.
- Automatic Renewal: Your Subscription will automatically renew unless you cancel it or we terminate it.
- Refunds: Refunds are handled on a case-by-case basis. Please contact support for refund requests.
- Price Changes: We reserve the right to modify subscription fees. Price changes will be communicated in advance.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon or violate our intellectual property rights or those of others
- Transmit any malicious code, viruses, or harmful data
- Attempt to gain unauthorized access to our systems or user accounts
- Use automated systems (bots, scrapers) without our express permission
- Interfere with or disrupt the integrity or performance of the Service
- Resell, redistribute, or share account access with third parties
- Use the Service for any purpose that is harmful, fraudulent, or illegal
6. Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Painscout and its licensors. The Service is protected by copyright, trademark, and other laws.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Painscout.
7. Data and Content
The data presented through our Service is aggregated from publicly available sources. While we strive for accuracy:
- We do not guarantee the accuracy, completeness, or timeliness of information
- Business decisions based on our data are made at your own risk
- We are not responsible for any losses resulting from use of the information
- The data is provided for informational purposes only
8. Limitation of Liability
In no event shall Painscout, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
9. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
10. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination:
- Your right to use the Service will immediately cease
- You may request a copy of your data within 30 days of termination
- We may delete your account and associated data after the grace period
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Painscout operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
